Obtaining a marital restraining order is a multi-step process. An initial request must be filed with the court, and this initial request will either be granted for a short time or denied. Either way, a hearing will be set. You will be required to attend that hearing. The other party must be served with the restraining order and must also show up to the hearing. At the hearing, the judge will ask both parties about what happened and can make determinations about who should stay in the house, what custody should be on a temporary basis, whether support should be paid, and in what amount, and other issues. Often, to address all issues in a restraining order takes multiple court appearances.
